Our prospects

The application of modern electronic systems of procedure activity and its inner control supporting is an important direction of bodies for disputes settlement activity, acting at CCI perfection. At the end of 2006, in ICAC at the Chamber of Commerce and Industry of the Russian Federation, the subsystem of the rules electronic support was put into operation, which is the first component of the Information system of arbitral investigation (ISAI), which is intended as for reflection (fixation) of the case movement, and also for providing of proper and timely implementation by all the members of the procedure of the necessary procedure movements, including the ones for automatic tallage calculations and for arrivals registration.

After ICAC, the similar subsystems will be created for the Court of Arbitration and MAC.

It should be said that such system is the first one in Russian and international practice and it fundamentally differs from the information systems of a number state courts. Drawing an analogy, one can state that these systems differ in the same way as, for example, the Rules of ICAC from the Arbitral Procedure Code. These distinctions are caused by the peculiarities of the dispute settlement procedure and by those procedure tasks, which should be solved in the court of arbitration. Thus, the considerable sets of questions are connected with those points of procedure, which have no place or bad-constructed in the state courts ( forming of the bench, tallage calculation and registration with the usage of three currencies (ruble, dollar, euro) and with automatic currency transfert).

The list of tasks on every working place allows to raise the labour productivity of secretarial staff, who are relieved from the necessity «to bear in mind» the consistency of actions on several dozens of cases. The application of the system allows to make necessary actions on every concrete case and to choose the proper variant of the Rules realization in the non-typical situations in minimum term. In this case, the probability of the mistaken actions and lashes by the staff comes down. For example, in the case of the response on the part of the Respondent delay, the system will issue a massage that «the Respondent didn't submit an explanation in time» and it is necessary «to appoint the arbitrators on the part of the Respondent by the order». In the system the list of the tasks is created for each Automatic Working Place, and this list causes different functionality of every AWP.

One of the advantages of the system is a quality which is typical for all «proper» information systems: multiple usage of the source once-written information. The system provides, particularly:

• review of the information about the cases in electronic form without application of any written documents;
• generating of different documents on the basis of models with the autosubstitution of the cases numbers, titles of the parties, sums in dispute;
• the recite of different statistics reports.

The possibility of the recite of different statistics information will be in full measure appreciated by analysts and experts, who had to do it earlier manually. On the different levels the users receive available them information with the different degree of detailed elaboration.

Thus, from its AWP each of them can receive quickly, in particular, the following information:

• about the amount of claims received for determined period of time;
• about the allocation of cases on different stages of the procedure;
• about the parties of the dispute from the angle of countries and cities;
• about the case statistics on the subject matter of the dispute;
• about the allocation of the cases basing on the price category;
• about the current capacity of the arbitrators and reporters;
• about the case statistics according the results of examination.

We would like to note the consistency of the ICC RF in the automation of the Centre of arbitration and mediation in the framework of the project «ISAI»: in the year 2005 there was created the separate site of ICAC and there was elaborated the first version of the System maintaining the Rules. In the year 2006 in connection with the advent since the 1st of March of the new ICAC Rules, there was effected the system modernization with the addition of the financial module.

In the further plans of the ICC RF on the development of the expert support system of ICAC Rules, insuring arbitrators and the parties an internet access to the information about the course of the examination of the case, and further - the organization of the work with the electronic documents in the on-line regime.
